Representation for Tax Audit

Income Tax Returns are selected for examination for many reasons and it doesn’t necessarily mean that you have done something wrong, and it is most likely that your tax return was selected by a systematic way to verify income, expenses or other type of deductions as part of the IRS compliance procedures.

Representation for Collections:

The initial step in the collection process is for the IRS to establish an “account receivable” in the taxpayer’s name by assessing the taxpayer’s liability. The assessment step is vital because the IRS cannot collect the unsatisfied portion of the assessment by administrative means until the IRS demands payment, which in turn cannot be done until a proper assessment has been made. If all or part of the assessed amount remains unpaid, one or more of the collection actions will be taken.
The procedure for collecting delinquent taxes involves several phases. The first phase consists of a series of computer-generated notices sent to the delinquent taxpayer from the IRS Campuses. Cases not settled during the notice phase are processed through the Automated Collection System or are forwarded to a Revenue Officer in the local IRS Compliance Office who contacts the taxpayer to resolve the matter.

Representation for Appeals:

Generally, the Appeals Office has jurisdiction to determine liability for all federal income, estate, gift, employment, and excise taxes, as well as liability for any additions to tax, additional amounts and penalties under Chapter 68 [Reg. 601.106(a)(1)(ii)]. On the other hand, it lacks jurisdiction with respect to alcohol, tobacco, or firearms taxes [Reg. 601.106(a)(3)]. Appeals jurisdiction is limited in cases already docketed before the Tax Court, civil fraud penalty cases, criminal fraud cases, and many types of bankruptcy cases [Reg. 601.106(a)(2)].

Appeals responsibility includes, but is not limited to, the following types of cases (IRM 8.1.3.1):

• Income, estate, gift, employment, and excise taxes;
• collection due process and collection appeals program;
• offers in compromise;
• penalty appeals;
• abatement of interest;
• administrative costs under IRC Sec. 7430;
• jeopardy levies;
• refund claims, including Joint Committee cases; and
• recommendations concerning settlement offers in refund suits

While settlement authority is extremely broad and the Appeals Officer’s intent is to settle cases without litigation, settlement is not automatic.
